EB-5 Visa Demand Slows in Early 2019; Launching Vietnam Forward and Calling Into Question Whether India Retrogression Will Take Effect This Fiscal Year

Last fall, we covered perhaps the most important EB-5 development of the year,DOS’ Chief of the Visa Control and Reporting Division Charles “Charlie” Oppenheim’s projections for various countries’ EB-5 visa backlog times, based on an October 2018 filing. Of particular note were longer than expected wait times for Mainland China and Vietnam, and a warning to the industry to brace for India’s backlog to begin “no later than July 2019.”However, more recent data calls these projections into question. New EB-5 Regulations Expected Soon as USCIS Finalizes Rule and Sends Text to OMB

For over two years, we’ve extensively covered USCIS’ proposed EB-5 Modernization Rule. On Friday, February 22, USCIS formally completed its revisions to the proposed rule via the notice and comment process, sending its draft of the Final Rule to the Office of Management and Budget (OMB). There is no published timetable for OMB’s assessment and publishing of the Final Rule into the Federal Register. Learn more in this blog.

Congress Passes EB-5 Regional Center Extension to Dec. 21; Measure Heads to President’s Desk

Early Thursday, both houses of Congress passed a short-term spending bill that would extend the EB-5 regional center program and other immigration programs requiring reauthorization to December 21, 2018. The House and Senate passed the legislation by voice vote after cancelling roll call votes this week, affected by the State funeral and National Day of Mourning for President George H.W. Bush. The bill is now being sent to President Trump for his signature.

At the AILA / IIUSA joint conference on October 30, 2018, DHS’ Chief of the Visa Control and Reporting Division Charles Oppenheim gave his projections regarding wait times that families subject to the EB-5 visa backlog might face. His presentation provided the most up-to-date projections available based on current information. The numbers provide key insights for many, especially those weighing EB-5 who have teenage children that might “age out” due to long visa queues.
